Welcome to gretchenjohnsonphoto.com. By accessing this website or booking a session with Gretchen Johnson Photography, you agree to the following terms. Please read them carefully.

1. Intellectual Property
All content on this site, including photographs, text, graphics, logos, and design, belongs exclusively to Gretchen Johnson Photography and is protected by United States copyright law. You may not copy, download, screenshot, reproduce, crop, edit, or distribute any images or text from this site without prior written permission.
Gretchen Johnson retains full copyright to all photographs created during client sessions. Clients who purchase digital files receive a personal use license to print and share those images for non-commercial purposes. Commercial use, stock licensing, and third-party sales require a separate written agreement.

2. No AI Training or Scraping
All images, text, and content on this website and delivered to clients are expressly excluded from use in training, fine-tuning, or developing any artificial intelligence, machine learning model, or generative system. Automated scraping, data mining, harvesting, or use of this content for dataset creation is strictly prohibited without prior written consent from Gretchen Johnson Photography. This prohibition applies regardless of whether the user is a person, bot, or AI system, and extends to both the website and any images delivered through client galleries or third-party platforms.

3. Booking and Session Retainers
A non-refundable retainer is required to reserve your session date and time. Your date is not held until the retainer is received. The retainer secures your place on the calendar, covers pre-session planning and preparation time, and is applied toward your total session investment.
Retainers are non-refundable under any circumstances. If you need to reschedule, your retainer may be applied to a new date within six months of the original session, with no additional rescheduling fee. Sessions rescheduled beyond six months require a new retainer.

4. Cancellations and No-Shows
Cancellations made by the client forfeit the retainer. If Gretchen Johnson Photography must cancel due to illness, emergency, or circumstances beyond her control, every effort will be made to reschedule at a mutually convenient time. No-shows and same-day cancellations forfeit the retainer and any additional session fees paid.

5. Weather
Outdoor sessions may be rescheduled due to weather at the photographer’s discretion. Rescheduled sessions due to weather do not incur additional fees and do not count against the six-month reschedule window.

6. Image Delivery and Turnaround
Selected images from your session are hand-edited by Gretchen and delivered through a private online gallery. Turnaround time is typically three to four weeks from the session date. Rush delivery may be available for an additional fee.

7. Print Products and Wall Art
Printed products, albums, and wall art are central to the Gretchen Johnson Photography experience. All prints are produced through professional labs and are sold directly through the studio. Self-printing of digital files is permitted for personal use but quality and color accuracy cannot be guaranteed outside of the studio’s print partners.

8. Model Release
By booking a session, clients grant Gretchen Johnson Photography the right to use session images for portfolio, website, blog, social media, advertising, and marketing purposes. Sharing client work is an essential part of how the studio attracts new clients, builds its body of work, and sustains the business.
Clients who wish to opt out of public use must submit a written request before the session. Because opting out limits the studio’s ability to market and grow, a privacy fee may apply to sessions that are not permitted to be shared. The amount will be discussed and agreed upon in writing before the session takes place.
A separate model release may be provided for specific commercial or editorial use beyond the standard marketing purposes listed above.

9. Use of This Website
You agree to use this site for lawful purposes only. You may not attempt unauthorized access, introduce harmful code, or interfere with the functioning of the site. Misuse may result in termination of access and legal action where appropriate.

10. Third-Party Links This site may link to external websites for your convenience. Gretchen Johnson Photography is not responsible for the content, privacy practices, or accuracy of any third-party sites.

11. Disclaimer and Limitation of Liability
Gretchen Johnson Photography makes no guarantees regarding the accuracy, availability, or reliability of this website or its content. The studio is not liable for any damages arising from the use or inability to use this site, including data loss, service interruptions, or content errors.
In the unlikely event of equipment failure, image loss, or other circumstances preventing delivery of session images, liability is limited to a refund of fees paid for the affected session.

12. Privacy
Personal information collected through this site is governed by our Privacy Policy.

13. Changes to These Terms
These terms may be updated at any time. Changes will be posted on this page with a revised date. Continued use of the site or booking of services after updates indicates acceptance.

14. Governing Law
These terms are governed by the laws of the Commonwealth of Pennsylvania. Any disputes will be resolved in the courts of Chester County, Pennsylvania.
